  3. Were do I start my Mortgage is Indy Mac Services,a division of OneWest Bank.This has been an on going thing starting last year .But when it became my full time job was back in September When I got my
    statement,Witch let me tell I get at least five statements a month all having diffrent amounts showing in the account information,like my escrow balance would be $758.44 an the next statement would be $399.50- but like i said this has be an on going thing with them but when i did call about the amounts being diffrent oh god they would tell be things that i thought do they think i stupid, but what ever i just put it under the rug. But like i said back in September when I got my statement that was dated 9-7-12 in the part where they post Transaction since last month they had 9-7-12 Funds Applied !,622.57, 216.46 principal deferred interest ,1,097.27 interest,288.82 escrow,20.oo misc\fees then i get a statement on 9-14-12 the same as the one on 9-7-12 but funds being posted on the 9-14-12 same amount 1,622.57 ok so then i get a statement on 9-17-12 now in the transaction since last month it starts

    9-14-12 1,622.75 funds applied that first being then 9-13-12 1,622.75 pmt. Reversal then 9-7-12 1,622.5, funds applied at last but not least 9-16-12 65.69 fee assessment .Now keep in mind thats four statement in one month now we go to October date of statement 10-18-12 an it has funds app on 10-18-12 1,622.57 10-16-12 65.69 fee assessment ok then we get statement on 10-24-12 that states on 10-24-12 pmt reversal 1,622.57 . So never mind that i have called them a million times nothing asking about what the heck in between all the statements i am getting letters saying my escrow account is short witch I can not belive cuz I don’t rember when we got a letter saying that we now have to pay 288.82 for escrow shortage oh it was 167.76, so we did like about a year ago so when I got the letter saying i was short again I hit the roof never mind to we have been trying to do modification Thats a big joke i send the forms in they send back saying i sorry your missing docoument this bla bla it is a bunch of bull.ok back to my whole issue so i call asking about whats going on why are you sending me a million statements all being diffrent an why did my

    payment on such a date not go through . why are you saying it was reversal never mind that they stright up did not have one of my payments they told me to send. in leagl doucment my statement now this was in early October oh I did I am not kidding you at least a thousand times so in mind December I kid you not I was on the phone with then every day faxing never mind you don’t talk to the same person they tell me they can’t except my statement it could be altered,So now I go to my bank I ask if they could send something they do they say they do not get it so I become chummy with the gairl from my bank in claims she has faxed them i don’t know how meny times oh but yesterday i get a letter that said sorry you need to take this up with your bank we coudl not vefire oh my god ya cuz the dates they had I have no clue were they got them from when i call my girl at bank in claims that has been helping she almost went through the floor she said they had all thy need you mean to tell me they have not posted your account never mind that I am In defult my credti they are saying I am three months behind I am not what will it take for them to post my account let me tell you I am at my wets ends on the flip side after I told them I was going to turn them into the fed gov about the esccro boll low in behold I get tow letter back to back say in in 2011 a check was sent but it has not been cashed if i did not recive singh an fax back to then so they can issue me a new check for 1.674.67 second letter saying the same thing diffrent date for 1.336.99 I singhed I just got the checks but they still have not posted my acccount

  8. IndyMac seems to have a culture of fraud. Check out the LA Times articles in Feb and July of 2011 on their executives.

    I can confirm they certainly appear to engage in deception as a common business practice.

    >They said unemployment insurance counts as income for HAMP–it does not.

    >For HAMP income verification, they require ‘live’ paychecks instead of direct deposit statements if you have your paycheck directly deposited into your checking account.

    > They sent my forebearance agreement out by overnight mail 2 days before it was due, and included a letter dated over 10 days prior which said the agreement must be signed and returned within 10 days.

    >They agreement said if I made my payments timely, they would not report it as past due. They have and are going after foreclosure.

    I contacted my congressman–Dan Lundgren–his office was useless. They referred it to the Office of Thrift and Savings. The OTS asked IndyMac if they were doing anything wrong. Gee, guess what IndyMac said?

  14. Indymac bought my mortgage from American Mortgage..which was at 8.5%
    I moved and rented the house out.
    I stopped making payments when it was sinking me.

    They sent me 3 mod aps and denied them 3x.
    They also sent me a trial mod payment offer that I decided,( based on their non offer meaning they did not have to modify even if I made those payments) not to accept.

    I chose not to go any further.

    I got foreclosure papers. My tenants got the same papers. Now they didn’t want to pay their rent.
    I had a foreclosure lawyer use produce the note.
    They produced the note.
    Discontinued the lawyer who advised me that they would not modify the loan non owner occupant.

    They offered me a short sale.
    The house was sold in 2 months for 1/2 of what I owed on it.
    I just got the 1099-c that I am working to deal with for the tax return.

    they sold my house to deutsche bank for $1,000.00
    and now they are trying to take me to civil court. on feb. 18/2011 “name petition for possession”
    they only gave 10 to go to court.

  18. Tila Solutions is beating these guys up pretty good from what I hear. They are a company that is proving time and time again that lenders are NOT legally able to foreclose on one’s home. Amazing group. My next door neighbor’s house was for sale recently. They not only got it taken out of that que, but they were able to modify the loan and get a balance reduction. My neighbor was told by (Indy Mac / One West) – “We don’t do modifications”.
    The securitization audit Gladys purchased changed that. She got a 2.5% rate for 3 years and a fair market value reduction. Lots and lots of fraud was found.
    Glad to hear someone is stepping up for the fight.

  19. I lost my house in Garden Grove, CA to foreclosure in
    Sep 2008. My 1st. mortgage was with IndyMac bank and my 2nd mortgage was with BofA. I spent (1) year
    trying to qualify for a loan modification, only for IndyBank to loose my documents more than (3) times.
    I sent them 3 months of lower payments via cashier’s checks and after wasting alot of time, sent them back to me with no explanation. It seems like they were very
    unorganized and never really wanted to help me in the first place. They finally foreclosed using Deutche Bank

    Under the current MERS and other law breaking rules the banks have exercised to foreclose on homes, I am wondering if there is an Attorney out there who can help me sue the Bank and bring me back to my original state where I could have saved my home if the modification they promised me would have been approved. Loosing my home has put my family under terrible stress. Please HELP !!!!

    We should not ALLOW these Fat Cats and white collar crooks to get away with causing so much pain to so many displaced families.

  22. If you are being foreclosed on by Northwest Trustee Services Inc and Routh Crabtree Olsen PS, take a look at the web site of NW Trustee Services-http://northwesttrustee.com/TSG.aspx
    where the PUBLIC can order a copy of the title for $39.00. This is private information about you! I called the title company and they knew nothing about NW selling these, and said that they didn’t approve, that the title report they issue (that costs you $1000+ and even you cannot get one given to you) is private and solely for the trustee and beneficiary. Everyone that has or is being foreclosed on by NW Trustee Services needs to make a complaint to the Attorney General in the state in which they reside. Routh Crabtree is the actual person that sends it out to the public. Routh Crabtree acts as a debt collector – so that’s a violation of the Fair Debt Collection Practices Act USC 15 1692.
    How can they resell private information? In NW trustee web site, it states they’ve performed over 100,000 foreclosures….There was one trustee that recently lost in court in WA because they didn’t practice “good faith” to all parties. Apparently there was a sale, but they ignored the sale and foreclosed anyway…

  25. We’re in the midst of an Indymac foreclosure, which I too thought the government had halted? Unfortunately, they continue to pursue the foreclosure, under their “new” name/company…One West Bank.! Were also forced to file bankruptcy, filing the day before the sale, in order to stop the sale. Evidently, “they” failed to do their homework, & the sale went forward! (it was null & void) So they scheduled another sale date. The point I want to bring up, is that it was sold to DEUTSCHE BANK! Could they be a new company formed by Indymac? Also, in the meantime, we received a letter from Indymac asking if we dispute any part of our loan…I replied disputing every part…especially increasing our $2,000 monthly payment (that we were UNABLE to pay) to over $4,000 a month! Our loan amount of $396,000 has also increased to $454,000…despite our property value dropping well below $300,000 AND the sale they held in error? Sold to DEUTSCHE for just $289,000! The response I received from my dispute letter…nothing more than their printed statements! Also requested the original Deed of Trust…none was sent to us! I too have heard that when these loans are split up & sold to “investors”, the bank recoups their money, sometimes several times over…how could this possibly be LEGAL? We are 58 & 63, on fixed incomes, this was to be our last home purchase & our last move…Now scrambling…looking for a less expensive property to purchase, not sure we can even qualify…less income than before & now bankruptcy in our file?   29. sorry late reply, “trustee” for indymac servicer said they would postpone for 1 month, i dont get why they did this ( attorneys( who didnt want to go the distance )request to “try to work something out” like what i ask you?, clearly the word modification is nonsense) so they totally intended to carry out the trustee auction on my home 1 month later, 1 day befor the sale i was forced to file a chapter 13 BK, otherwise my home would be long gone as arizona is a no redemption after sale state. i now have suit filed in fed court but still no legal representative and im trying to get an attorney that will help me win, fraud in the inducment of the contract,rescinded… so thats the latest i have, i would appreciate any of you good peoples advice who know what this means. deb wynn
