Having recently attended the Neil and Brad’s Workshops in Florida, I would highly recommend attending them if you are within a days drive of the seminar. If you can’t you should definately order the Lawyers Workshop handbook if you are trying to defend your own case Pro Se or Pro Per without a lawyer. If you have a lawyer and he hasn’t been to the seminar then buy a copy and give it to him. Let it do the talking for you…when you actually know more than your attorney because you have been researching this site and others and try to question him you may come off as trying to tell him how to do his job. Buy him/her the book and send him a link to a recent post on this site once every week or so you get him reading livinglies….just my $.02
How do you know that a lender has sent you the original note and has proper ownership of it. They could just send a Note with a stamp on it that says “this is a true and certified copy of the original”.

HELP! We live in Oregon, we filed bankruptcy in 2004. We completed bankruptcy March 15,2007. Upon completion of bankruptcy we received a court document showing that claim #10 in the amount of $112,809.33 had been disallowed in full and signed by the judge on Nov. 30,2004. While we have been trying to figure out what this meant we have been making our payments due to consistant letters of “foreclosure” threats. Every time we do not make a payment they call and tell us that it does not matter what we have they will foreclose on our home, so we keep paying. We have asked a few different attorneys and one said we owe the money and the others have told us to obtain an attorney that specializes in such matters. All the attorneys we have talked to so far say the paper work does not mean what it says. We contacted the bankruptcy court they tell us to get an attorney to contact them. Now 2 1/2 years later we are still making payments because every lawyer says to keep the payments current, so they can’t put us out we need a lawyer that can help us with this problem. How can they put us out when a federal judge signed papers saying “disallowed in full” $112,809.33. Thank You for your time, Mary

Michele: Either file a lawsuit demanding that they record it or file an affidavit that says you have it and see if they will record that. The county recorder’s office is wrong and take a political stsand with an agenda. Their act of taking a document for recording is ministerial not discretionary.
If anyone ever finds an attorney in Tucson or Phx. tell them to call me too. M&I Bank is illegally auctioning off my 5 acres and unbuilt house, on September 9, 2009. I keep reading different areas that there are attorney’s who “Gets It” in the network, in our area but I have “never” come across one. M&I Bank funded my construction loan money to a contractor who did not build me a house, and without my signature, and without me knowing until two months later when I received an invoice, and for work not done and never started. I demanded M&I Bank to STOP FUNDING, they told me it wasn’t my decision to make, and they are not permitted to discuss my loan with me. M&I Bank concealed documents and tampered documents. M&I Bank funded off of the contractor’s contract that reads; ” Due to the nature of this situation, we are not aware of the cost to this point or the potential cost for the project.”
I thought my loan was only $250,000.00 but suddenly it is close to $650,000.00.
“Home owner must pay his own taxes and Insurance.” And I did, but M&I Bank added it on thier documents as a line item anyway and then they paid out $8,400.00 insurance and tax money to the contractor, after I already paid it.

Could you create a customer feedback on these attorneys. So far in Arizona they have come and gone the seasons. Right now I have in front of the Arizona bar and trying to get back $2500. I met with another who would change what they would do each time we spoke and what they would charge. I believe in what you are doing, but finding a good attorney has become a huge gamble. It’s like all the ambulance chasers have switch professions. A consumer rating would be most helpful, so we could weed out the bad ones. P.S. the one that I’m chasing has had his name removed from your list.

Al Calderon….If you do not have a credit card you can purchase the Prepaid Visa cards (100. value) 2 of them and a 50. one………they can be purchased just about anywhere and you can use them just like a credit card (online ordering etc.) or fax Livinglies with the card info…..you will get your workbook…best of luck…

Does any one know if you have accepted a loan modification in the past from the loan servicer, does that eliminate the ability to use the “produce the original note strategy” in the event they try to foreclose?

There are several ways to secure downloads of a book so that it can’t be illegally distributed. I haven’t tried this service, but I found it on a google search. Maybe there are others like it? I’d be curious to find out what you think.

I purchased the Home Owners version of the handbook, and it is definitely a worthwhile investment.
The problem with publishing/distributing the Attorney or Homeowner workbooks as PDF’s or any other form of electronic means is that once the document is sent out, there is no way to control the distribution of the documents. The money paid for the workbooks compensates the producers (Neil & Co.), and I am sure goes directly towards the continued support of this web site.
Payment for the documents via PayPal should/would present no major problems that I can think of. My work encompasses the hosting over 150 NewsPrint and Magazines on the Internet, and PayPal is by far the best quick payment scheme available.
The PayPal web site provides all of the tools, including links and icons, to make the sale of information or products relatively seamless and cost effective. (Just consider the volume of transactions that eBay does using it!!) I am pretty sure that the costs if using PayPal versus Credit/Debit cards is either comparable, or more cost effective.

I am a mortgage broker in Michigan that uses reverse mortgages to get senior homeowners out of foreclosure. I would like to do my own forensic mortgage audit but don’t know how to get the information from the original lender, current servicer and closing title company. Do you offer any training for this?
