My Foreclosure Sale date is less than 2 weeks away, I’m being foreclosed on by Deutsche Bank in Florida. I have had an attorney that had me protected until this latest hearing last Friday. My attorney filed a Motion to set aside the Final Judgement based on Two Fraudulent documents that was pointed out to the Judge, The Judge looked at the Documents and Still he denied my Attorneys request. My Attorney then Asked the Judge for Clarification “Judge you are admitting that the documents are fraudulent, but you are still denying my request?” The Judge said Yes! All the other attorneys in the Court said they could not believe the Judge would do that. The Judge actually said this case has gone on long enough, request denied. So now My attorney says she does not do Appeals. I’m out of Money, as I am now Disabled with 3 Kids and I have decided to go into the Clerks office tomorrow and Go thru the Case Documents. Oh by the Way there was not a Court Reporter in there Friday, however my Attorney says she will provide me an Affidavit of what happened to use on my Appeal. @Sara, thanks for the info. No, here in MA they don’t go to court to proceed with a foreclosure. I was in the early stage of providing the paperwork for the HAMP modification with American Home Mortgage Servicing/Deutsche Bank where no activity is to be taken if any has been started. Received a couple of letters from American Home Mtg re; missing documents, re-faxed, then I receive a ltr 12/24/11 from an atty that Deutsche Bank bought my home at an auction on 12/1/11 the same date of a letter from AHMSI requesting a missing document…Interesting, per the servicing co., no foreclosure action was being taken or even set for 12/1/11 and how does the bank my loan is “suppose” to be with buy my house? My ultimate goal is I am owning my home mortgage free and clear, helping to stop the abuse by Deutsche Bank and help others who are willing to fight to keep their homes. In addition, I don’t believe the securitized loan assignment done back in 2007 with the fall of Ameriquest was even legit but that will all come to light and I will prevail! Gina, I had some financial problems and I couldn’t afford to make payments on my mortgage anymore, I stop making payment to the Servicing Bank of my Loan: “American Home Mortgage Servicing” (AHMS) back in 2008, I received a Foreclosure Summons by Deutsche Bank National Trust Company as Trustee for American Home Mortgage Assets Trust 2006-5…etc., etc., etc… on 05/18/2009
I respond them the Summons (of course!!), since they give you 20 days to do so.
Since that day until today they can not prove in Court they are the real party in interest or they have standing to take me to foreclosure at the moment they present me the Summons, they don’t even have a clean title of ownership, this was done a year after!(illegal!)
I have lots of illegal situations on this Foreclosure, in my State (FLA) they can not foreclosure on a property if they don’t show up the original promissory Note, they said in an affidavit they don’t have it, that the Note was lost or destroyed!
I hired a Lawyer who seems knows what he’s doing, nothing is happening in my case until this moment, hopefully nothing will happen, and if 5 years pass and they cannot prove Legal rights over my property the Plan B will be to do a “Quiet Title”, and if this happen I will have the Property Free and Clear. They are nobody!, they are fraudulent, the Attorney’s Office that represents them are also under investigation (in my case was SHAPIRO & FISHMAN, LLP.) also MERS it was involved in my case.

I asked God for guidance, and I found this site. Can someone give me some direction. I live in MA. I actually submitted my documents for a loan modification. Received a letter that a couple of items were missing and submit by 11/30/11. Faxed the documents, again. Received a letter dated 12/1/11 that those same documents were missing and sumit by 12/16/11. Faxed again. Today, Christmas Eve, I received in the mail, a letter from an atty with a realtor listed that my property was bought my Deutsch Bank in an action on 12/1/11! Yes, my loan was with Ameriquest, then Citibank, then American Home Mortgage Serving/Deutsch Bank as the trustee and so on. Interesting, there isn’t any public notice of an auction on 12/1/11 for my property. I have been a message for the atty that sent the ltr, the realty that is mentioned in the letter and of course, American Home Mortgage Servicing is closed….Does anyone have any information so that I am armed and ready to deal with them on Monday? Has anyone fought IndyMac/OWB (servicer for Deutsch Bank) in Virginia? I’m trying to fight them from foreclosing on my mother’s home. The judge ordered Deutsche Bank to pay our attorneys fees of $7,521 & court costs also.
I have been battling with Deutsche Bank & thier mortgage servicing co. (Ameriquest then Citi Residential & last but not least American Home Mortgage Servicing) since 2007. They had forclosed on my home in 2007 & then recinded it & then forclosed again in Dec. 2010, illegally of course. They had filed a forcible detainer against my husband & the constable had been out here & gave us 10 days to get out. The only problem with their eviction was that when we refinanced our home in 2005 they put the loan in my name even though I don’t work, I am a homemaker so when they only filed the forcible detainer in my husbands name he is the only one they could make move out. The constable was really confused on what he had to do legally. We finally told my husbands grandparents what the deal was & they had a good friend that is an attorney, not even in this area of law, he took our case & hired a bank expert to go threw our closing documents & he found several not only illegal but things that are plainly stated in the United States Constitution that they had not done. They never provided us with any documents prior to the day we closed, they loaned way more than 80% of the home value, they charged more than 3% fees & they did not have my husband to sign the 3 day right to resend. The penalty, as stated in the Constitution, is forfieture of the lein & any principal & intrest owed against the home. Here is the real kicker, Deutsche Bank nor their attorneys even answered to the court after they were served to appear. So we were scheduled for a TRO hearing @ 1:30 p.m. today in the 402nd District Court Room & they did not even show up or send representation. We won by a default judgement & if they file an appeal in District Couort they will have to pay another $3,000 for our attorneys fees & in Supreme Court it will be another $3,000. I’m hoping we never hear from these people again. Although I have a few things I would like to say to them about what they have put me threw the last 5 yrs. I hope that someday the people who had a hand in causing my family so much heart ache, depression, mental stress & at one time almost a divorce get them a taste of what they caused me. There is no feeling like thinking that your home is being ripped away from you that you have been paying on for 13yrs. before financing with these thieves or to have your child ask you if we were goin to be homeless. I know that they will have to answer to our maker someday, i’m sorry to say, I hope he hath no mercy on their souls.

@ Hawaii – What you need o do first of all is pray. Then what you need to do is go down to your county clerks office and pull all your paperwork. That’s how I found out these crooks filed a fraudulent claim against my home. Also request request a free copy of Prospectus Supplement from the SEC (Securities and Exchange Commission) and that would show the Cut-Off Date and Closing Date from when whomever your mortgage company is was suppose to assign your assignment of mortgage. Just make sure you get every piece of paperwork to prove fraud. The assignment of mortgage and a title search will show and tell it all. Just ask GOD for knowledge, wisdom and understanding and he would direct your path.

Your defense is the title- suggestion: file a complaint to the title, think about it; they came after you with title documents!
A judge will tell you over and over the fraud is out of their jurisdiction, WHY!!!! Because the Civil court/State court/UD is only about possession. NOT FRAUD-STAY AWAY you can only fight in federal/District court– Fight back use your evidence in a title complaint go directly to the source. Order your documents from SEC; make sure they are certified (all documents you use must be certified) that will stand as your material facts. Get an audit done (NOT FORENSIC) on your “deed of trust” for Prima ficia evidence. Order a Bloomberg audit for your expert witness and watch them run. My nightmare started with Ameriquest then after the big multi million dollar lawsuit ($295 million) they passed my note on to Citi Residential but after I brought to their attention all the illegal things done, by Ameriquest, to even get this loan Citi Residential resinded the foreclosure & passed it off to American Home Mortgage Servicing & for 2 yrs. i’ve been trying to get something worked out with people from India. They gave me the same run around with modification & in the mean time they foreclosed & it went to auction but was bought back by Deutshe bank national trust. My foreclosure papers say Deutsche Bank National Trust backed as trustee for Ameriquest backed pass threw certitificate series 2005…. with a pooling & service agreement. Whatever all of that means.
Anyway we spoke with a local attorney Monday & he is giving all my documents to a retired banking president to pick threw & see what we can do to the people who forclosed. We would never have been in foreclosure if Ameriquest had not sent our payments back to us.
IWe are already to the point they filed a forcible detainer but not in my name they only filed it in my husbands name & they are the ones that put the house & loan in my name even though I don’t have a job.
I just hope this local lawyer knows what to do.

For everyone that has problems with their mortgage, you have to be positive first, and become educated in this matter there is so much free information with the intrenet. This will guide you towards making the right decision. I also think that it is good advice to have your closing documents audited to see if their are any problems with them. Yes you will have to pay for this. But it will help you out a lot. We all know that our home is the largest investment in our lives, and that we feel somehow that we have been violated. But please people the only way that we can survive this is to become more educated, and not intimidated. These banks are like big bulley’s, if you let them they will take it.
My house was foreclosed yesterday August 30, 2011 at 10am. My foreclosure papers say duestches soundview trust. I’m out of town working. I paid a law office at 9am on the 30 to stop the sale with a emergency BK. They charged me but didnt file electronically. They sent me wife down to the federal court clerk to turn in the papers. The clerk wouldnt accept them. First, I have to be present with id to turn in and pay for the application.#2 the papers where the wrong papers. The clerk took the name and number of the legal service and said it would be turn into the justice office.
I’m so pissed off , but i”m going to get through this. Wells Fargo is in
( ) on foreclosure docs along with duestches and sound view. I called wells fargo back in 08′ when this started, they said they didnt have my loan. Now this year 2011. They say they do, but I have to deal with Americas Servicing Company, wich has been collecting my payments. I have paid $15K total between two different modifications working directly with ASC. They voided them both after I had signed new loans at 4.8% interest, 30 yrs. They said I was to pay a “contribution fee” before first payment. They give me 2 weeks to do this. The fee was $3400.00 and my mortgage payment was 825/mo. on a 110K loan your do the math. That wasn’t in my budget.
I called ASC yesterday after the sale. I told them I just talked to the auction company, it did sell, back to the bank, for 38,000.00. est.
I explainewd what had happen and they said I could write a letter of rescind. Stating a legitimate reason why they sale should be waived/cancelled.
!1. Can I write this letter and will it bear any weight?
2. Should I sue this lender? All I’ve heard is problems and faud. How can I win against a Bank?
3. A judge told me there has to be a settlement hearing. Was there a hearing I missed that caused default?
4. are there any Attorneys in Indiana? I haven’t found one yet! Or that knows how to go about this. All they want to do is file BK.

Has anyone heard of IMPAC Funding Corp. I won my foreclosure case a year ago for lack of standing but without prejudice, recently the same firm served fraudclosure papers from the same plaintiff. This time they did a corrected assignment, the first was from MERS to Deutsche, this time its from MERS to IMPAC then IMPAC to Deutsche. The signers on the doc. all work for GMAC as well as the notaries.

There may be some help there for someone. We have court tomorrow again. Strange turn of events but the Judge issues an order for Deutsche bank to plead and prove their standing on possession of our home after ruling against us and filing the order on Feb 4 2011. Due to judicial error the judge filed COURT’S ORDER TO SHOW CAUSE TO SET ASIDE JUDGMENT ENTERED FEB. 4, 2011 AS VOID FOR LACK OF JURISDICTION.
Part of what we had submitted was notice from the Secretary of States office that Deutsche Bank was not registered to do business in California.
However, Deutsche has now submitted a crap load of case law saying the judge can not set aside after an original decision and order.
We are submitting the Calif. Evidence Code Section 354 stating that a judge CAN set aside because the error did result in a miscarriage of justice. (fingers crossed)
I think a BIG point we have all missed is first finding out who Deutsche Bank REALLY is. Many sleepless days and nights over the past months but seems it has paid off at least to the point of knowing who (what) we are up against.

I work with an attorney here in Florida helping people in foreclosure. We have a client who filed chapter 13 and whose BK attorney dropped the ball, leaving her Wells Fargo mortgage out of the BK. An auction date ascended and we were told by that attorney that everything was fine. The BK had not yet been discharged. It was two days before the sale date that we found out the truth. Being unable to stop the sale, I contacted a local state Senator who tried in vain to help me. It was too late. The bank bought back her home. Knowing I had ten days to appeal, I did research in the courthouse of all her docs to find that Deutche Bank had no securitization in my clients property. There were many breaks in her chain of title and Wells was the lien holder, not Deutsch Bank. We were able to get a reprieve until yesterday when we had a hearing to dismiss. Deustch showed up with a title that showed their endorsement. The judge ruled in their favor. This leads me to believe that anyone can show up with an endorsement and win. What am I missing here? Can we appeal and save this poor woman’s home??? Please advise.

How can anyone in State or Federal court get a fair trial if the Judges or Courts have an interest in your home (They may have stocks with the Banks so there is no way we can win our case unless we change court or judges). However, what do you do if the Court has an interest in your property?

Anyone interested please respond. As in a previous email I explained the judge awarded me back the attorney fees I paid to my onlline UD attorney. The attorney does my paperwork and I represent myself in court. I served the banks attorney with the order and to date there has been no payment. I’ve been fighting Deutsche, Bravo Credit(performance One). Believe me they are reprsented by the most evil attorney firms out there. I’ve sued them in Federal Court with an attorney and then he got my suit partially dismissed. I continued on as Pro-Se and have part of the suit in the 9th circuit court of Appeals. Bravo did not show up for court until a Request for Ddfault was filed and then they suddendly come alive and are not doing a motion for dismissal of my second ammended complaint when they were not even in court for the first complaint. I need help to decide what to file as a response or to dismiss the case without prejudice and file in my local court along with a suit against Ocwen Loan Servicing whom I have not named in any of the other suits.
Ocwen foreclosed illigally and now they are trying since August to do an unlawful detainer which they have screwed up so much that their first one was dismissed by the judge. I was awarded attorneys fees of 900. the judge signed the order and they were served and to date they have not paid. Would anyone know their bank account number for Deutsche? I’m in California. The LAWS dictate that the bank (or pretender lender) must offer PROOF of OWNERSHIP.
DEMAND a “pre-trial settlement conference.” Mediators are not allowed.
Make this an all or nothing wager. (Wall Street likes betting with other peoples’ money, right?)
Give the bank (or pretender lender) 60 DAYS from the initial hearing to produce the ORIGINAL NOTE (EVIDENCING THE ENDORSEMENTS IN BLANK or NO ENDORSEMENTS for TRUSTS?) – PLUS the ALLONGES, and ORIGINAL MORTGAGE.
Modern forensic analysis – to be paid by HAMP – would verify the credibility of the documents. Ink and paper can be time-dated with modern technology. Furthermore, hand writing analysis techniques and forensic computer technologies are also available and very refined today. Furthermore, The CEO’s (of the employees who “VERIFY” the accuracy of their own signing authority as evidenced in their own affidavits,) would be “sworn in” for perjury and other related potential criminal actions. This would also perhaps eliminate forgeries and criminally manufactured documents by the banks (or pretender lenders,) their foreclosure mill attorneys, and/or their default document preparation firms… To further GUARANTEE and ENSURE fairness, the Homeowner would choose the forensics firm who would operate under the penalty of perjury and fraud.
This simple wager would be established as follows:
1- The pretender lender would “sign off” at the initial “pre-trial settlement conference” on the mortgage and note, (FREE AND CLEAR with clean, marketable title, including the pretender lender’s assumption of all future liabilities for “John Does’ 1- 1000.”) The homeowner would then drop all future claims and counterclaims, and own their home free and clear. Further criminal prosecutions would be dropped for this individual case.
2- IF the pretender lender would NOT “sign off,” then the FORENSIC TESTING RESULTS – OR pretender lender’s NON-COMPLIANCE … in the following 60 days … would determine the FINAL OUTCOME of their claim.
3- At the end of 60 days at the NEXT summary hearing, (held exactly in 60 days,) IF the bank CAN LEGALLY
PROVE THEIR OWNERSHIP by producing the legally necessary documents to the court, the HOMEOWNER has 30 days to peacefully surrender the premises without any further litigation.

I too am fighting with Ocwen, Saxon, litton and Deutsch bank. I just hired a man who was suppose to file a TRO for Wrongful Foreclosure. On the grounds that they have led me to believe they were working on a loan mod with me, then served me with an exceleration of the note notice. Just like everyone else here, they claim they never recieved any paper work. Liars.
This man I hired did in fact file the petition and TRO, however, he did not serve the parties legally. It was thrown out of Court. Now he wont take my calls. I am informed and believe that I need to file an amended petition and TRO, Do I also need to file a Lis Pendens, and does anyone know where I can download a copy for texas?

I don’t know what state you’re in but you have to go down to wherever they filed papers to foreclose on your home and get copies and send them to every government official as I did. Do not give a lawyer your money because 99.9% of them are crooked and just want to take your money. Go pro se as I did. I had a lawyer who took my money and did absolutely nothing. I paid him to fight for me but yet he’s having conversations with the adversaries as if they’re buddy buddies. And I had to do my own investigation in which that is what I paid him for. That’s why he’s no longer my lawyer.
I submitted my motion to the Supreme Court based on discovery of fraud and was granted. If you’re dealing with Saxon and Deutsche Bank trust me it’s bogus and YOU MUST KEEP FIGHTING……GOD did not bring you this far to leave nor forsake you now. They are Forclosing in my Condominium, it seems my Servicer transfer via Mers my Mortgage, now they are the Plaintiff in my case…something is very wrong here!
I need someone to help me please, just last week my son received some papers from a servicer, they serviced my son the law suied on my home, which is Deutsch Bank/AHMSI, In Edmond, OK, I have to respond bank by the 20th of April, If I don’t respond back to the law suite against me, they will take my home, which my parents had since 1967, my mother is hancicap, I have been working with AHMSI since April 16, 2009 with the loan modification, they tell me they need more income information, I faxed over 14pages back on that day, then again, I mailed some more paper work on a pakages for the AHMSI send another pak to me to fill out, this is the third time on filling out the paper work, the package says to have it back to them by April 14,2010.
Just last Thursday or Friday I spoke with AHMSI with Hope Now , on the phone at the same time, lady from Hope Now ask AHMSI about the law suite, AHMSI said they know nothing about that and they are in control of my loan with my house.
Lady from Hope Now ask if the house is in foreclosure he said yes, Lady from Hope Now ask what the date is on the foreclosure, man from AHMSI said there no date on the foreclosure.
It was just the week before when my son got the papers, from the company who was servicing them.
And I have been working with this AHMSI since April 2009, I was told by AHMSI that they weren’t doing the loan modification back then, why is that so funny when I got the papers from their web site about the loan modification back in 2009.
We people can’t let this company take our homes and then for the government to say they are helping home owners stay in their homes, When us American people where told by the Mr. Obama that he wants to help people stay in their homes, but I just found out today from speaking with attorney that in Jan 2010 Obama told the Attorney General he can take off the Mirrors that was put on homes being foreclosure on back in 2009 and 2008.
So that was taken off and now look what is happening to us American people that banks are going in and takeing people homes and now their will be more homeless people out on the streets because of our BIG MAN in office and wanting to run everything from banks, car companys and now health insurance companys,

I am also a victim of Saxon and Deutsche Bank, they foreclosed on my home in Las Vegas I requested Saxon to produce the original note in late Oct2009, they never did,they foreclosed and transfered the title back to Deutsche Bank, and they never even notified me. I found out when a note was place on my door by a realtor advising I now longer owned my property, and to contact them within 48hrs which I did. I turned down the cash for keys, and last week realtor contacted me again with same offer. I would never have know about Saxon transfering my deed to Deutsche Bank, but my daughter looked up my property on recorders site and saw the deed transfer. These low lifes didnt even advise me of this. Scum bags, we all need to write our congressman and ask for help. I already did this,but havent heard back as he was in middle of getting health care reform approved in Nevada.
Anyone know why the only lawyer I’ve seen in here has no way to be reached? Who / where is George E. Babcock, Esquire?

Any attorneys in California that are in the know on how to fight Douche Bank? These banks are giving their attorneys the big bucks to get these lawsuits dismissed when the homeowner has TILA violations. By the way what is the statute of limitations on these violations? Also heard they would rather foreclose than work with clients becasue if they foreclose they can get the full balance from an insurance co. Something called credit swaps. Please comment on the validity of this.

My attorney filed a suit against Deutsch 11/07 for a fraudulent loan. At one time he had a TRO preventing foreclosure. He let it expire and I continued to bug him to do something so he filed chapt 13 and let it get dismissed. I had several TILA violations in my loan. Unknown to me after all of this time the bank filed to dismiss my case and got it dismissed. Now I have a trustee sale pending for 8/10/09. What can I do now? I called Deutsch and they were extremely rude when I asked for the mortgage Dept. They said they don’t do mortgages that I need to contact Ocwen my loan servicer.
I asked if they received tarp funds and the person said,”no”, the servicer received them. Doesn’t that mean under HR3221 that they have to work something out with me? The Gov gave the banks money to help us and they are not using it for what it was purposed for.

How can I find out if they have the original note signed by me ? Also I need to know if Deut is required to work something out so I can stay in my home under HR3221. I wanted them to drop the principal to accomoate a reverse mort. My attorney says they laughed at that suggestion.
My attorney is being very rude also, says he needs money to file an appeal and since I have no money he will not do it. I suspect he got paid under the table by the bank to act in this way. He has done the same to another client of the watchdog agency. Never keeps clients informed and does whatever he likes without the clients permission.
Today I defeated Option One/Sand Canyon/AHMSI in Providence, RI Superior Court. Found not to be a successor in interest. Huge implications and a tremendous tool to use against all three parties. I will keep you informed.

Just this week, I have had judges order lenders/MERS/servicers to produce the note. They can’t. It is funny to see what they come up with. It is sad to see the lengths they will go to steal a person’s home.
Over the past year my entire practice has been focused on foreclosure defense. I am also a victim of Deutsche Bank I was sent a letter for massive amount of late fees and mortgage payment after just being late 2 months the amount should of been 1,400.00 plus late fees after grace period of 15 days $50 late charge but instead was sent an amount of:4,328.91 from Deutsche Bank to be paid immediately to avoid foreclosure. They won I was scammed and now I am to leave my house any minute I have court this Tue May 19,09 at 8:30 a.m. to be evicted because I would not sign a release form that noted that I was leaving the property voluntarily and that releasing them from any future law suits or demands etc; HomEq, Nations Choice, and Deutsche are all responsible for taking my home! They took advantage because my house has (HAD) a lot of equity. My moms whole life savings! Somebody has to do something! What is the government doing about this? Will someone PLEASE HELP! Deutsche Bank is performing mass foreclosures in NJ without being the note holder, while I was negotiating with the original lender. I got a foreclosure notice and went to the courthouse to find out that there was no legal assignment of my mortgage. Deutsche Bank needs to be sued.
A group of people in the Inland Empire of Southern California is in need of an Attorney who can represent homeowners after they have been evicted through an unlawful detainer that was objected.
